These are important for anyone who is thinking of using Havemybook service for buying or selling textbooks to fellow students.
This Site is offered and made available only to users 18 years of age or older who reside in the United States of America, its territories and possessions ("U.S."). If you are not yet 18 years old, or do not reside in the United States, please discontinue using the Site immediately, or if for any reason, you do not agree with all of the terms and conditions contained in this agreement, please discontinue using the Site immediately because by using or attempting to use the Site, you certify that you are at least 18 years of age and meet any other eligibility and residency requirements of the Site.
1. Code of Conduct
We at Havemybook wish to create a friendly and safe environment for all our users, this code of conduct has been created with this in mind. While we welcome diverse opinions, your contributions to the site must comply with the following rule of conduct: Posting any comment that is: abusive, hateful, racist, bigoted, sexist, harassing, threatening, inflammatory, defamatory, knowingly false, vulgar, obscene, pornographic or is in any way in violation of applicable laws, rules or regulation. Any violation of these above rules of conduct may result in the removal of users posting, revocation of registration and the banning of the registrants email address.
2. General Terms & Conditions
2.1 Havemybook Functions as a Buying and Selling textbooks between College students.
2.2 When using the Havemybook Buying & Selling service, please recognize that Havemybook is not responsible for any consequences resulting from meeting face-to-face between Buyer and Seller (college students).
2.3 By meeting face-to-face with fellow students you acknowledge that Havemybook is not responsible for any consequence you receive or do not receive, and you agree to hold Havemybook harmless from any loss, harm, injury or damage resulting from or arising out of your meeting in public or private.
2.4 Havemybook reserves the right to change the site terms & conditions at any time. Havemybook may also remove, ban, or modify users & contributions without notice & reasoning.
2.5 Havemybook will not tolerate the gaming or manipulation of systems for self promotion or unfair point and rating gathering. Users caught abusing Havemybookâs proprietry systems will be removed without notice.
3. Buyer & Seller Term Condition
3.1 Buyer & Seller are responsible for his or her action when meeting in public or private. Havemybook is not responsible for any monies or textbooks being lost or stolen in the event that it occurs.
3.2 Buyer & Seller are responsible for providing any form of contact information with each other, such as: cell phone numbers, email address, fax numbers, work numbers, and home phone numbers. Havemybook is not responsible for any misuse of contact information. That responsibility rests on the buyer or seller alone.
3.3 Meet up Face to Face. Through Havemybook we provide tools that enable our users to arrange physical meetings at venues that include, but are not limited to, school grounds and public venues. We do not supervise these Havemybook meetings and are not involved in any way with the actions of any individuals at these meetings. As a result, we have no control over the identity or actions of the individuals who are present at these meetings, and we request that our users exercise caution and good judgment when attending these meetings.
3.4 Release. Because we do not supervise or control face-to-face meetings or interactions among or between members of Havemybook or Alliances and other persons or companies, and because we are not involved in any way with physical transportation to or from face-to-face meetings or with the actions of any individuals at meetings, and because we cannot guarantee the true identity, age, nationality of Havemybook users, and because we have very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of Havemybook users you agree that you bear all risk and you agree to release us (and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and Organizers and their designees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of Havemybook, your Third Party Transactions, our resolution of any disputes among users, and/or your transportation to or from, attendance at, or the actions of you or other persons at, a meeting. You further waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a release or waiver. You waive and relinquish all rights and benefits which you have or may have under any provision of the statutory or non-statutory law of any other jurisdiction in the US and its territories to the full extent that you may lawfully waive all such rights and benefits.
4. Indemnity
4.1 You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
5. Copyright Information
Information on web sites is available for anyone to view, but not necessarily to access, download and utilize. Users of web sites may electronically copy or print portions of web sites for their own personal, non-commercial use. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on web sites is generally prohibited. All content included on this site, such as text, slogan, graphics, logos, button icons, images, data compilations, and software, is the property of Havemybook or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Havemybook and protected by U.S. and international copyright laws.
